Terms of Use

Conditions governing access to and use of the concrit.ch platform.

Purpose and Acceptance

These terms of use (hereinafter "Terms") govern access to and use of the ConcrIT platform, available at concrit.ch, published by ConcrIT, a sole proprietorship under Swiss law (hereinafter "ConcrIT").

By creating an account on concrit.ch, the user acknowledges having read these Terms and accepts them without reservation. Use of the service is reserved for adults (18 years of age or older) acting in a professional or academic capacity. ConcrIT reserves the right to verify the status of any user and to refuse access without providing reasons.

User Account

The user is solely responsible for creating and securing their account, in particular for keeping their login credentials confidential. Any use of the service from the user's account is deemed to have been carried out by that user.

The user undertakes to provide accurate data upon registration and to keep it up to date. ConcrIT reserves the right to suspend or delete any account whose data is inaccurate, incomplete, or whose use is contrary to these Terms, without prior notice or compensation.

Description of the Service

ConcrIT is a SaaS platform for finite element method (FEM) calculation and reinforcement optimization for reinforced concrete structures, intended for qualified engineers and professionals.

The service is provided "as is", without any warranty of completeness, accuracy of calculation results, or fitness for a particular purpose. ConcrIT is a calculation assistance tool and does not in any way substitute for the professional judgment of the engineer responsible for the structure.

ConcrIT reserves the right to modify the features of the service at any time, including adding, modifying, or removing features, without this giving rise to any compensation.

Financial Terms

Access to the service is subject to the following pricing terms:

Free trial

All new users receive a 14-day free trial from the date of account creation, with full access to the service. No credit card is required.

Billing

To retain full access beyond the trial period, the user pays an annual license, invoiced by QR-bill at the rates in force. Payment may be made during the trial period. Invoices are issued in Swiss francs (CHF), inclusive of Swiss VAT at 8.1%.

Late payment

In the absence of payment by the due date, the user's access is automatically limited to read-only mode. The user's data is retained. Full access is restored upon receipt of payment.

No refunds

Payments made are final and non-refundable, except in the case of a billing error attributable to ConcrIT.

Pricing

The applicable rates are those displayed on concrit.ch at the date of subscription. The rate is guaranteed for the duration of the current subscription period. ConcrIT reserves the right to modify its rates for renewal periods, subject to notifying the user with reasonable notice before the renewal date.

Acceptable Use

The user undertakes to use the service in accordance with applicable law and these Terms. In particular, the user is prohibited from:

  • Accessing or attempting to access other users' accounts or ConcrIT's systems without authorization.
  • Using the service for unlawful, fraudulent, or immoral purposes.
  • Reproducing, copying, reselling, or commercially exploiting all or part of the service without prior written authorization from ConcrIT.
  • Introducing viruses, malicious code, or any element likely to disrupt the operation of the service.
  • Using automated processes (bots, scrapers, crawlers) to access the service or extract data from it.

ConcrIT reserves the right to immediately and without prior notice suspend access for any user in breach of these obligations, without this giving rise to any compensation.

Intellectual Property

The ConcrIT service, its source code, algorithms, interfaces, brand, and all content are the exclusive property of ConcrIT, protected under Swiss intellectual property law (CopA, SR 231.1 and TmPA, SR 232.11).

An exception applies to the JCONC Java applet, available on the i-concrete.ch website.

The user is granted a personal, non-exclusive, non-transferable right to use the service, strictly limited to the duration of their active subscription. This right does not include any transfer of ownership of any kind.

Data created by the user in the course of using the service remains entirely the user's property. ConcrIT acquires no rights over such data, subject to the provisions relating to aggregated and anonymized data set out in the Privacy Policy.

Suspension and Termination

The user may terminate their subscription at any time by contacting ConcrIT at team@concrit.ch. Termination takes effect at the end of the current subscription period. No refund is due for the remaining period.

ConcrIT reserves the right to suspend or terminate a user's access, without prior notice or compensation, in particular in the event of:

  • Breach of these Terms or applicable law.
  • Persistent non-payment after the due date.
  • Abusive or fraudulent conduct, or conduct detrimental to ConcrIT's or other users' interests.
  • A decision by ConcrIT to cease or substantially modify the operation of the service.

Upon termination, user data is processed in accordance with the Privacy Policy available at concrit.ch/confidentialite.

Warranties and Limitation of Liability

ConcrIT provides the service without warranty of any kind, express or implied, as to its completeness, accuracy of results, or fitness for a particular purpose.

ConcrIT shall not be liable for any direct or indirect damages of any nature arising from the use or inability to use the service, including any loss of data, opportunities, or revenue. In any event, ConcrIT's total liability is limited to the amounts actually received from the user during the twelve (12) months preceding the triggering event.

The user is solely responsible for verifying and applying the calculation results provided by the platform. ConcrIT emphasizes that its tools are calculation aids and do not replace the professional judgment of the civil engineer responsible for the structure.

Amendments to the Terms

ConcrIT reserves the right to modify these Terms at any time. In the event of a substantial change, the user will be informed by email or by a visible notice on the platform with reasonable notice. Continued use of the service after the new Terms take effect constitutes unconditional acceptance thereof.

Applicable Law and Jurisdiction

These Terms are governed by Swiss law, excluding its conflict of law rules. In the event of a dispute and unless otherwise required by mandatory law, exclusive jurisdiction is vested in the courts at ConcrIT's place of business, in the Canton of Vaud (Switzerland).
